Punishable Offenses In Information Technology Act

The world of information technology has been growing with every passing day and now more than 80 percent of the total world population is dependent on the information technology segment. Therefore, the criminal and fraud activities in this sector is also increasing at a faster pace and for procuring the citizens of India from such criminal and fraud activities the Government of India has brought up punishable provisions to safeguard its citizens from these crimes. Few of such criminal offenses and punishment for such offenses are listed herein below which are mentioned under the Information technology act, 2000:-

  • “Publishing of any information which seems obscene in electronic form” which means if any person publishes, sent or transit any information through the electronic or information technology source which is obscene(related to sexual content) or same sort of content is of prurient nature then shall be shall be liable to punishment under section 67 of the information technology açt with imprisonment up to five years or fine of rs.1,00,000 or both.
  • “Trying to access or securing to access to a protected system” which  means that if any person tries or attempt to aces to any of the secured computer system authorized by the official government gazette or official government system then that shall be considered as an offense under the information technology act, section 70 and same shall be liable to punishment for imprisonment up to ten years or fine as deemed by the court or both.
  • “Misrepresentation” which means if any person make any sort of misrepresentation or make any suppression of any document or anything from the central authority or the controlling authority in order to obtain the certificate, digital signature or license for something then that will be considered as misrepresentation and shall be considered offensive as per section 71 of the information technology act, 2000 and same shall be liable for punishment as imprisonment for up to three years or fine up to rs.1,00,000 or both.
