Right to Education

Introduction:-

Right to Education Act or The Right of children to free and compulsory education Act came into existence on August 4, 2009. This is quite an important legislation for our country which has been considered as a landmark as it has marked changes in our educational system and provides betterment for the poor segment of society in terms of education.

Enforcement of the Right to Education Act:-

The act came into force from 2010, In our country and with the enforcement of this act our country is positioned one among top 135 countries where education is considered as a fundamental right of every child.

Although Education has been a part of Fundamental rights of every citizen from the year 2002 by the mandate of Eighty six amendment in the Indian Constitution in Article 21A it has been inserted that “ The state shall provide every children from age 6 to 14 years a free and compulsory education as per the determination of the law”.

Therefore, Right to education was removed from the state directive policies and has been added to the fundamental rights of every citizen by the eighty six amendment in our constitution.

Provisions laid under Right to Education Act:-

  • Right to free and compulsory education shall be provided to each and every citizen of the country aged between 6 to 14 years till the time they complete their elementary education in the government school in their neighborhood.
  • The act makes it clear that it is on the part of the government that every child should get the right to admission, right to attendance and right to complete elementary education.
  • The act clearly states that the word “free” mentioned in the act is in accordance with the children that no charge shall be payable by children which may prevent him/her completing their elementary education.
  • This act provides provisions for the children to get admitted to the class as per his/her age for completing their elementary education.
  • This act specifies for sharing the expenditure of education between the central and state government and also mentions all the duties of the parents, governments and respective local authorities in relation with the education for the children.
  • It mentions the norms and standards for pupil teacher ratio, working days of the school, infrastructures of the school such as buildings.
  • The act provides prohibition of teachers to be posted for non-educational work apart from the work related to elections, census and disaster relief work.
  • The act also provides equality for posting teachers in both rural and urban areas.
  • The act also works that proper training has to be provided to the teachers and the teachers posted should be properly qualified and trained.
  • The act has strict regulation and prohibits any sort of mental harassment or physical punishment on children and also has a screening for the entire children's treatment in school.
